Welcome to The 79. These Terms of Service govern your access to and use of our website theseventynine.co. By using our website, you agree to comply with these terms and conditions. If you do not agree with any part of these terms, please do not access or use our website.
Website Use and Content:
a. You may use our website for lawful purposes and in accordance with these Terms of Service. You are responsible for ensuring the accuracy and legality of any information you provide through our website.
b. All content on our website, including text, graphics, images, videos, and logos, is the property of The 79 and protected by copyright and other intellectual property laws. You may not use, reproduce, modify, or distribute any content from our website without our prior written consent.
User Accounts:
a. Some features or services on our website may require you to create a user account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
b. You must provide accurate and complete information when creating your account, and promptly update any changes to keep it current and accurate.
c. We reserve the right to suspend or terminate your account if we suspect any unauthorized use or violation of these Terms of Service.
Prices:
Prices in this website are based on known costs as per service date and are subject to change without prior notice as they may be influenced by any price increases (fuel surcharges, entrance fee increases, taxes…).
Prices listed on www.the79.com are per person unless otherwise specified. Unless otherwise stated in the tour description, prices do not include drinks, personal expenses, entrance fees, domestic flights, personal travel insurances, visa fees, port dues and gratuities to guides and drivers.
Information Needed for Giving the Services:
Due to local tourism legislations, for each passenger The 79 will need the full first name(s), family name, date of birth, citizenship and passport number as per passport which will be used during this travel.
The 79 kindly ask its customers to give all means of contacts during their itinerary so that The 79 can contact their customers in case of necessity.
Payment:
Payment can be made by mail order, credit card or bank transfer. If the payment is made by the credit card, there will be the supplement fee to total amount of services.
For payments by bank transfer, the customer will be informed of our bank details in due time via e-mail. Any charges which may occur from the bank(s) will be at the expense of the customer.
The total amount of the service is due latest … prior to the start of the tour.
Service Charge for Itinerary:
The 79 has travel consultants on pay-role besides assigning freelance advisers and consultants on special interest travel itineraries. When we are asked to prepare a travel itinerary and gather the necessary information on the sites, without any bookings; there is a service charge involved – as seen on the below charts; to cover our communication costs, expertise, effort & time.
Itinerary Up to 3-5 hours
Less than 1 week ………- Euros
1 week- 10 days ………- Euros
11-14 days ………- Euros
More than two weeks ………- Euros
Amendments by the Customer:
Amendments are allowed subject to availability up to 1 week prior to departure yet possible price differences will be calculated and depending on the amount of work involved, each change may incur an amendment charge in addition to any further costs or charges that we incur from our suppliers in making the alterations.
If the visit to museums and galleries which stated in the package that the customer chose earlier, can not be made due to the amendment by the customer, there will no responsibility of us and there will be no refund.
Cancellations by the Customer:
Should you for any reason have to cancel your booking(s) you must give us a written notice of cancellation signed by the person who initially made the reservation. Cancellation charges are dependent on the supplier’s terms and conditions vary accordingly.
Except otherwise stated, any cancellation of tours, packages or any other services will be refund under the conditions below:
Before 30 days: is subject to a cancellation fee of 10% of the confirmed travel package total.
29-15 days: is subject to a cancellation fee of 20% of the confirmed travel package total
14-10 days: is subject to a cancellation fee of 30% of the confirmed travel package total
9-5 days: is subject to a cancellation fee of 60% of the confirmed travel package total
4-2 days: is subject to a cancellation fee of 90% of the confirmed travel package total
Less than 48 hours – to first service date, is concerned as a full no-show and the full amount is fortfeited.
Please note that there will be no refund of any unused component during your holiday
Amendment or Cancellations by The 79 or its suppliers :
The 79 and its service suppliers reserve the right to amend or cancel any of the services. The refund only will be made if the amendment or cancellation resulted from our fault and the customer would not agree with the proposed alternative services.
Delays in services - due to cases of force majeure - or any other reason (traffic jams, last minute re-organization for the well-being of the customer, technical defects of the vehicles...) are not considered as amendment nor cancellation. Delays are just beyond the control of The 79and/or their supplier and can happen.
Force Majeure :
Are considered as "Force Majeure" all events beyond the control of The 79 and their service suppliers which may prevent the realization of the services such as natural disasters (earthquakes, floods, epidemics), war, union actions as all what may result of these.
In case of "Force Majeure" The 79 and the concerned service suppliers will not be held responsible but will advise their customers, if at all possible, as soon as possible by e-mail or telephone. The 79 will also do whatever is in their power to assist their customers, ensure their safety and if necessary try and organize their return to their home country upon agreement of the Consulate of the customer's country.
Should a customer, due to a "Force Majeure", have to interrupt services booked via theseventynine.co. The 79 cannot be held responsible for it nor be asked compensations.
Guides :
The exclusively works with official tour guide and where possible, guides specialized in the subject of the tour booked. The tours proposed in this website are based on English and/or Arabic speaking tour guide yet if you wish guidance services in another language, please do inform us accordingly. Depending the requested language tour prices may need to be adapted (tour guidance in “seldom” languages tend to be more expensive than English).
Personal Insurance :
The personal insurances such as; health, loss or theft of belongings is not included in our services. The 79, highly recommends that you purchase travel insurance from your home country for your travel package.
By Turkish law, every individual and group traveler have to have valid travel insurance.We strongly recommend that you purchase comprehensive travel insurance from your country, which covers medical, and repatriation expenses, personal baggage and personal effects, loss or theft of money. If you want us to provide it for you at the expense of charge; it has to be indicated while conforming the desired travel services. In particular cases, cancellation fees, if incurred involuntarily, may be covered by insurance taken out at this time. The 79 will not accept responsibility for any person who fails to be properly insured for their journey.
Travel insurance can further protect you in the event of cancellation due to unforeseen occurences.
Accident or Loss :
The 79 have no liability for loss, damage, delay, inconvenience, or direct or consequential loss, however caused, unless due to our employees’ negligence, in which case our liability is limited (except for death or personal injury) to a maximum of the refund of the tour cost.
The 79 do not own or manage the hotels, vehicles, accommodation and restaurants used and we have no liability for loss or damage caused by the proprietors or operators thereof. Baggage is at owner’s risk throughout the tours.
Prohibited Activities: When using our website, you agree not to:
a. Engage in any unlawful, fraudulent, or harmful activities.
b. Impersonate any person or entity or misrepresent your affiliation with any person or entity.
c. Interfere with or disrupt the operation of our website or the networks connected to it.
d. Use any automated system, software, or device to access, scrape, or retrieve data from our website without our prior written consent.
e. Upload or transmit any viruses, malware, or harmful code that may damage or interfere with our website or the data stored on it.
